GENERAL SALE CONDITIONS
When you put in an order with us, it means you agree with our general sale conditions in case no particular contract has been signed by a person in charge in our company.1. Delivery
- The company will do her best to meet the orders within the time allotted on order. However, the customer will also have to agree that the deadline is given for information only : Therefore, a delay in the delivery will not give rise to any recourse.
- The company will do her best to keep the customer informed in case there is any delay in the delivery.
- Deliveries are made according to one of the INCOTERMS which has been stipulated between both parties. If it's not mentioned, the delivery will have to be made up to the EXW incoterm.
- The buyer has to take delivery of the goods as soon as they are available on the day and at the place he can remove them.
- The risks that are linked to the goods will be passed on to the buyer on delivery or when the goods are ready to be collected on the day mentioned before or on the last day of the period and at the place of collection.
- Delivery within the time-limit settled before can only be made if the buyer has fulfilled all his duties towards the buyer.
- The seller will be exempted from delivering the goods or putting them at the buyer's disposal in case of a difficulty , an obstacle or a delay due to circumstances or events beyond control such as material shortage, strike, blocking of the lines of communication, bad weather, riots, war, restrictions or interventions resulting from decisions taken by the authority concerned such as vets (veterinary).
- All claims will have to be acknowledged by the seller as quickly as possible.
- A claim can only be justified if the delivered products have not been modified, if their nature or composition has not been altered, if they have not been repacked or reconditioned and at last if their conservation has been made according to legal prescriptions after delivery or disposal.
- After the validity of the claim has been recognized, a credit will be established or new products of the same quality (in conformity with the order)will be delivered.
- The seller's responsibility, whatever the motive it is, will never exceed the price of the faulty or undelivered products.
- An invoice will be issued for each delivery.
- Our goods must be paid by the expiry date mentioned on the first side of our invoices.
- The payment is said to be settled when the sum of money is available on the bank account.
- Payment before due date doesn't lead to a discount.
- A non-payment on the expiry date leads to immediate pay ability of all the sums of money due and the application of delay interests which correspond to 1.5 times the legal rate in operation on the expiry date.
- All charges and fees which are committed by the seller for the payment of the debts will be borne by the buyer.
- This sale is concluded with a retention of title in favour of the supplier. It's been agreed between the parties that the purchaser will get the whole property of the good only he's been paid the full price. If no payment has been made at all or in case of a part payment of the price and its accessories on the expiry date for whatever reason or case there may be, the purchaser will already grant the supplier permission to start making an inventory of all the goods belonging to him, either on a contradictory way or being assisted by a bailiff.
Any dispute regarding our sales comes under the competence of the Commercial Court of Broward county .
6. Frozen products :- All the goods must come from fresh meat (not under vacuum) and have a date of slaughtering which must be less than 48 hours.
- The packaging must be appropriate to each product according to the current standards and a schedule of conditions which has been approved.
- The freezing process must be carried out in a special freezing tunnel on shelves and at a temperature of -37° C minimum.
- The length of the freezing process is 24H minimum in order to get an inside temperature of -18° C.
- The storage must be made in a fridge which has been accepted by the EEC or USDA and the constant temperature of -20° C.
